The local health officer may grant a waiver from specific requirements of this chapter if he or she determines:

1. (1) That the waiver requested is the minimum deviation from the specific requirements of this chapter that is necessary for the conditions; and
2. (2) The alternative approach proposed by the person requesting the waiver is consistent with the requirements and intent of these rules.
