At any time public card game licensees are conducting card games, they must have:

1. (1) The food and/or drink business being commercially stimulated open to the public; and

2. (2) A licensed card room employee on duty and in the public card room area if operating the following card games:

   1. (a) Class F; or
   2. (b) House-banked; or
   3. (c) Commercial nonhouse-banked card games of poker or other nonhouse-banked card games specifically approved by the director or the director's designee and a fee is collected to play.
