1. (1) Local fire authorities will have the authority to issue civil penalty citations for violations of chapters 70.77 RCW and/or 212-17 WAC.
2. (2) A citation may impose a penalty or provide a warning.
3. (3) After issuing the citation notice, the citation will be forwarded to the state fire marshal within ten days of issuance. Each citation will be accompanied by a copy of the issuing authority's written report, inspection sheets, evidence receipt, or any other forms that are completed during the process of issuing citations.
4. (4) The state fire marshal will review the information contained in the citation and any accompanying documentation.

5. (5) If the evidence exists that a violation occurred, the state fire marshal will issue an administrative violation notice which will include:

   1. (a) A brief narrative description of the charged violation(s);
   2. (b) The date(s) of the violation(s);
   3. (c) A copy of the law(s) or regulation(s) allegedly violated;
   4. (d) A summary of the licensee's or permit holder's options as outlined in this chapter; and
   5. (e) The penalty.
6. (6) The civil penalty will be delivered using registered mail.
