An appeal may only be filed by the following parties with regard to the respective specified grounds:

1. (1) Unsuccessful bidders with regard to elements of the bid submittal and evaluation process;
2. (2) Complainants with regard to an agency response to their complaint; or

3. (3) Displaced or potentially displaced employees with regard to an agency's:

   1. (a) Adherence to the statutory notice requirements of RCW 41.06.142 (4)(a); or
   2. (b) Determination of the existence of a competitive market as provided in RCW 41.06.142 (4)(d).
