1. (1) The following manufacturers must register with ecology and participate in a CEP recycling plan:

2. (2) A manufacturer is registered under this chapter when:

   1. (a) Ecology has determined the manufacturer's registration form is complete and accurate; and
   2. (b) The manufacturer has paid the required administrative fee (see WAC 173-900-280).
3. (3) Registration under this chapter is only for purposes of administering the electronic product recycling program, and does not constitute endorsement by ecology of a particular registrant.
4. (4) A manufacturer must participate in either the standard plan or, if approved, an independent plan.
5. (5) In the event that the plan fails to meet the manufacturers' obligations under this chapter, each manufacturer participating in the plan retains responsibility and liability, including financial liability, for the collection, transportation, processing, and recycling of the manufacturer's equivalent share of CEPs as described in this chapter.
