1. (1) The department provides adoption services to any child in the department's care and custody:

   1. (a) With an identified permanent plan of adoption; or

   2. (b) When the department considers adoption as an alternate permanent plan; and

      1. (i) The child is in supervised out-of-home care; or
      2. (ii) The child's birth parent(s) requests adoption as a permanent plan prior to the child's placement in out-of-home care.

2. (2) The department considers families who apply for adoption services to be resources for children in the department's care and custody if the potential parent(s) is:

   1. (a) Legally competent;
   2. (b) Eighteen years of age or older; and
   3. (c) Has an approved adoptive home study.
