The caregiver reimbursement program:

1. (1) Is established to provide reimbursement coverage to:

   1. (a) Unlicensed kinship caregivers;

   2. (b) Those licensed by the department or by a child placing agency (CPA) in chapter 74.15 RCW, including:

      1. (i) Foster parents licensed in chapter 110-148 WAC; and
      2. (ii) Licensed kinship caregivers licensed in chapter 110-149 WAC; and
   3. (c) Certified respite providers when providing department approved respite;

2. (2) Covers:

   1. (a) Damages caused by children or youth who are in department approved placements, within available funds, including:

      1. (i) Property damages or property loss; and
      2. (ii) Emergency medical expenses for themselves or their household members;
   2. (b) Acts of ordinary negligence; and
   3. (c) Costs for approved items not covered by the caregiver's insurance and up to the total amount the department may pay for the occurrence, per WAC 110-50-1060; and
3. (3) Does not cover illegal or deceitful acts taken by the caregivers in subsection (1) of this section.
