1. (1) Caregivers, caregivers' household members, and individuals on the property having unsupervised access to children or youth must:

   1. (a) Meet the requirements outlined in chapter 110-04 WAC; and
   2. (b) Pass a background check.

2. (2) The department:

   1. (a) Must:

      1. (i) Disqualify caregivers or those living in a caregiver's home if they:

         1. (A) Do not meet the requirements outlined in this chapter; or
         2. (B) Cannot have unsupervised access to children or youth because they did not pass their background check; and

      2. (ii) Notify caregivers if an individual in their home is:

         1. (A) Disqualified from having unsupervised access to children; and
         2. (B) Cannot remain living in their home; and
   2. (b) May allow a child's or youth's parents or guardians who have been approved to reside in the home to support the children's or youth's case plan.
3. (3) Kinship children or youth placed in the licensed kinship caregiver's home do not need to complete background checks.
