1. (1) The department:

   1. (a) May issue a probationary license to correct a deficiency as outlined in RCW 74.15.125; and

   2. (b) Will consider the following when deciding whether to issue a probationary license:

      1. (i) Intentional or negligent violation of licensing requirements;
      2. (ii) History of violation of licensing requirements;
      3. (iii) Current violations of licensing requirements;
      4. (iv) Whether licensees are making a good faith effort to comply; and
      5. (v) Other factors relevant to the specific situation.
2. (2) Licensees do not have appeal rights if the department decides to not issue a probationary license.
