Licensees must meet the following privacy requirements for children and youth in their care, except as stated in subsection (2) of this section:

1. (1) Allow children and youth in care to:

   1. (a) Have privacy of communication as appropriate to their developmental capabilities, including:

      1. (i) In-person communication;
      2. (ii) Personal mail;
      3. (iii) Phone calls; and
      4. (iv) Electronic messages; and

   2. (b) Communicate with:

      1. (i) Their:

         1. (A) Attorney;
         2. (B) Representatives;
         3. (C) Therapist; and
         4. (D) School; and
      2. (ii) Crisis lines;

2. (2) May restrict children's or youth's communications:

   1. (a) When directed by:

      1. (i) The child's or youth's representatives; or
      2. (ii) Court order; or

   2. (b) Per the:

      1. (i) Licensee's technology use policy; or
      2. (ii) Child's or youth's individual technology use plan outlined in WAC 110-145-3070.
