The department:

1. (1) Must:

   1. (a) Disqualify applicants, licensees, their personnel, or subcontractors if they do not pass a background check, per chapter 110-04 WAC; and
   2. (b) Notify licensees when their personnel are disqualified from having access to children and youth in care; and

2. (2) May take an action against a license, per WAC 110-145-3560, if licensees or applicants:

   1. (a) Do not meet the requirements of this chapter;
   2. (b) Hire an individual disqualified by the department; or
   3. (c) Continue to allow an individual disqualified by the department access to children and youth in care.
