1. (1) DCYF will send written notice to subject individuals who are disqualified by the background check.

2. (2) If DCYF sends a notice of disqualification, subject individuals will not be authorized to:

   1. (a) Care for or have unsupervised access to children receiving early learning services; or
   2. (b) Be present on the early learning service's premises during the hours when child care is provided.
3. (3) Any decision by DCYF to disqualify subject individuals under this chapter are effective immediately upon receipt of written notice from the department to the subject individual.
