1. A. Except as provided in subsection C of this section, the affected facilities to which the provisions of this article apply are the following:

   1. 1. Each source of visible emissions; and
   2. 2. Each source of fugitive dust/emissions.
2. B. The provisions of this article apply throughout the Commonwealth of Virginia.
3. C. The provisions of this article do not apply to any source type subject to the designated standards of performance in 9VAC5-50-410 or subject to the designated emission standards in 9VAC5-60-70, or both, provided these standards include a visible emission standard.
