An operator is no longer required to maintain financial responsibility under this chapter for an aboveground storage tank or pipeline after the tank or pipeline has been permanently closed pursuant to the requirements of 9VAC25-91, except when the department determines clean up of a discharge from the aboveground storage tank or pipeline is required.
