1. A. Except when transfer is ordered by a court of competent jurisdiction, the provider's receiving service or facility shall document receipt of the following at the time of the resident's transfer:

   1. 1. Documentation of advance notification to the family, if appropriate, the resident, the placement agency, and the legal guardian;
   2. 2. A written summary of the resident's progress while at the transferring facility, justification for the transfer, and the resident's current strengths and needs; and
   3. 3. A copy of the resident's record.
2. B. The transferring service or facility shall document the date of transfer and the name of the receiving service or facility to which the resident was transferred.
