1. A. The department shall identify physical and mental conditions with high probability of resulting in developmental delay.

2. B. A child shall be eligible for early intervention services under Part C if the child is younger than three years of age and has:

   1. 1. A developmental delay as measured through the evaluation and assessment procedures described in this section; or
   2. 2. A diagnosed physical or mental condition with high probability of resulting in developmental delay.
