1. 1. The death of the qualified service member occurs in combat;
2. 2. The surviving spouse was married to the qualified service member at the time of the qualified service member's death; and
3. 3. The surviving spouse does not remarry.

The surviving spouse shall qualify for the exemption, so long as:
