1. (1) There is created within the division the Utah Multicultural Commission.

2. (2) The commission shall consist of the following 13 members, appointed by the governor:

   1. (a) one individual who advises the governor on education issues;
   2. (b) one individual who advises the governor on homelessness issues;
   3. (c) one individual who advises the governor on legislative policy;
   4. (d) one individual who advises the governor on criminal and juvenile justice issues;
   5. (e) one individual who advises the governor on issues concerning families and children; and
   6. (f) eight individuals who represent Utah's multicultural communities.

3. (3)

   1. (a) A member of the commission:

      1. (i) shall serve for a term of two years; and
      2. (ii) may not serve more than two terms.
   2. (b) Notwithstanding Subsection (3)(a)(i), the governor shall at the time of appointment adjust the length of terms to ensure that the terms of commission members are staggered so that approximately half of the commission is appointed every two years.
   3. (c) When a vacancy occurs in the membership, the governor shall appoint a replacement for the unexpired term.
4. (4) A majority of the members of the commission constitutes a quorum of the commission at any meeting, and the action of the majority of members present is the action of the commission.

5. (5) A member may not receive compensation or benefits for the member's service, but may receive per diem and travel expenses in accordance with:

   1. (a) Sections 63A-3-106 and 63A-3-107; and
   2. (b) rules made by the Division of Finance pursuant to Sections 63A-3-106 and 63A-3-107.

6. (6) The department shall make rules establishing the membership, duties, and procedures of the commission in accordance with the requirements of:

   1. (a) this chapter; and
   2. (b) Title 63G, Chapter 3, Utah Administrative Rulemaking Act.
7. (7) The department shall provide administrative support to the commission.
