1. (1) Terms defined in Sections 76-1-101.5 and 76-9-1501 apply to this section.

2. (2) An actor commits theft of baggage or cargo if the actor removes any baggage, cargo or other item transported upon a bus or stored in a terminal without the consent of:

   1. (a) the owner of the property; or
   2. (b) the bus company or the bus company's duly authorized representative.
3. (3) A violation of Subsection (2) is punishable under Section 76-6-404.
