1. (1)

   1. (a) As used in this section:

      1. (i) "Assault" means an offense under Section 76-5-102.
      2. (ii) "Employee" includes a volunteer.
      3. (iii) "Threat of violence" means an offense under Section 76-5-107.
   2. (b) Terms defined in Section 76-1-101.5 apply to this section.

2. (2) An actor commits assault or threat of violence against a school employee if:

   1. (a) the actor commits assault or a threat of violence against an employee of a public or private school;
   2. (b) the actor has knowledge that the individual is an employee; and
   3. (c) the employee is acting within the scope of the employee's authority as an employee.
3. (3) A violation of Subsection (2) is a class A misdemeanor.
