1. (1) "Kickback or bribe" means a rebate, compensation, or any other form of remuneration, that is:

   1. (a) direct or indirect;
   2. (b) overt or covert; or
   3. (c) in cash or in kind.

2. (2) "Kickback or bribe" does not include:

   1. (a) a fee that is:

      1. (i) shared between two or more individuals, each of whom is licensed to practice law; and
      2. (ii) charged for services provided in the individual's capacity as a licensee described in Subsection (2)(a)(i); or
   2. (b) payment for medical services rendered.
