1. (1) Each prosecutorial agency within the state shall collect and submit the following data to the department:

   1. (a) the number of prosecutions during the previous calendar year in which charges were brought against an individual based on the individual's false accusation that a felony or misdemeanor had occurred;
   2. (b) the disposition of each prosecution described in Subsection (1)(a); and

   3. (c) the number of cases during the previous calendar year for which an alleged violation of any felony or misdemeanor was dismissed or declined:

      1. (i) based on evidence that no crime was committed or attempted;
      2. (ii) based on insufficient evidence to establish a likelihood of success at trial; or
      3. (iii) because the victim was unable to participate.
2. (2) The information required by Subsection (1) shall be submitted to the department in the form and manner selected by the department.
