1. (1)

   1. (a) There is created within the General Fund a restricted account known as the "Public School Construction Oversight Restricted Account."

   2. (b) The account shall be funded by:

      1. (i) construction oversight fees collected under Section 63A-5b-1214;
      2. (ii) administrative fees collected for division-managed construction services under Section 63A-5b-1213; and
      3. (iii) any penalties collected under Section 63A-5b-1215.

   3. (c) Money in the account:

      1. (i) shall be used exclusively for public school construction oversight activities described in this part;
      2. (ii) may not be used for other division operations unrelated to public school construction oversight;
      3. (iii) does not lapse at the end of a fiscal year; and
      4. (iv) shall earn interest, which shall be deposited into the account.

2. (2) The Legislature may appropriate money from the account to the division for implementation of this part, including:

   1. (a) plan review and permitting activities;
   2. (b) inspection roster maintenance and oversight;
   3. (c) cost database development and maintenance;
   4. (d) training and technical assistance programs;
   5. (e) compliance monitoring and enforcement;
   6. (f) online document management system operation;
   7. (g) standardized design template development;
   8. (h) staffing costs directly related to public school construction oversight;
   9. (i) contracted services necessary for oversight activities; and
   10. (j) other oversight activities this part requires.

3. (3) The division shall:

   1. (a) maintain separate accounting for revenue and expenditures from the account;

   2. (b) upon request, report to the Legislature on:

      1. (i) total fee revenue collected;
      2. (ii) account balance;
      3. (iii) expenditures by category; and
      4. (iv) projected future revenue and expenses; and
   3. (c) ensure that fee rates are sufficient to fund oversight activities without requiring additional appropriations.
