1. (1) As used in this section:

   1. (a) "Governmental entity" means the same as that term is defined in Section 63G-2-103.

   2. (b) "Public information" means:

      1. (i) a record of a state governmental entity, a local governmental entity, or an independent entity that is classified as public under Title 63G, Chapter 2, Government Records Access and Management Act; or
      2. (ii) subject to any specific limitations and requirements regarding the provision of financial information from the entity under Section 67-3-12, for an entity that is exempt from Title 63G, Chapter 2, Government Records Access and Management Act, records that would normally be classified as public if the entity were not exempt from Title 63G, Chapter 2, Government Records Access and Management Act.
   3. (c) "Private, controlled, or protected information" means information classified as private, controlled, or protected under Title 63G, Chapter 2, Government Records Access and Management Act.
   4. (d) "Website" means the Utah Open Data Portal Website created in this section.
2. (2) There is created the Utah Open Data Portal Website to be administered by the division.
3. (3) The website shall serve as a point of access for public information.

4. (4) The division shall:

   1. (a) establish and maintain the website;
   2. (b) provide equipment, resources, and personnel as needed to establish and maintain the website;
   3. (c) provide a mechanism for a governmental entity to gain access to the website for the purpose of posting and modifying public information; and
   4. (d) maintain an archive of all public information posted to the website.
5. (5) The timing for posting and the content of the public information posted to the website is the responsibility of the governmental entity posting the public information.
6. (6) A governmental entity may not post private, controlled, or protected information to the website.
7. (7) A person who negligently discloses private, controlled, or protected information is not criminally or civilly liable for improper disclosure of the information if the information is disclosed solely as a result of the preparation or publication of the website.
