- (1) a licensee employing the services of an unlicensed person to perform work requiring a license under this chapter;
(2) an attempt to secure a license under this chapter through fraudulent or misleading means, including by:
- (a) omission of material facts or evidence;
- (b) filing with the division fingerprint cards for an applicant that are not the fingerprint cards of the applicant; or
- (c) making a statement verbally or in written form that is false or fraudulent and intended to mislead the division in the division's consideration of the qualifications of the applicant for licensure;
(3) practicing or engaging in, or attempting to practice or engage in, an activity for which a license is required under this chapter, unless the individual:
- (a) holds the appropriate license under this chapter; or
- (b) is exempted from licensure as provided under Section 58-92-306;
(4) employing another person to engage in or practice, or attempt to engage in or practice, an occupation or profession licensed under this chapter, if the employee:
- (a) is not licensed to do so under this chapter; or
- (b) is not exempt from licensure;
- (5) impersonating, permitting, or aiding and abetting an employee to impersonate a law enforcement officer or employee of the United States, a state, or a political subdivision of a state; and
- (6) violating, advising, encouraging, or assisting in the violation of a statute, a court order, or an injunction when engaging in conduct regulated under this chapter.
