1. (1) If a wireless provider's activity causes damage to a right-of-way, the wireless provider shall repair the right-of-way to substantially the same condition as before the damage.

2. (2) If a wireless provider fails to make a repair required by an authority under Subsection (1) within a reasonable time after written notice, the authority may:

   1. (a) make the required repair; and
   2. (b) charge the wireless provider the reasonable, documented, actual cost for the repair.

3. (3) If the damage described in Subsection (1) causes an urgent safety hazard, an authority may:

   1. (a) immediately make the necessary repair; and
   2. (b) charge the wireless provider the reasonable, documented, actual cost for the repair.
