1. (1)

   1. (a) The Utah System of Higher Education and participating institutions are not liable for any act, omission, or conduct of cooperative education employees or cooperative education employers.
   2. (b) A cooperative education employer shall indemnify and hold harmless all participating institutions against claims arising from co-op placements.

2. (2) The Office of the Commissioner of Higher Education shall:

   1. (a) establish procedures for:

      1. (i) program administration;
      2. (ii) risk management;
      3. (iii) issue resolution; and
      4. (iv) early termination protocols; and

   2. (b) develop policies regarding:

      1. (i) liability coverage;
      2. (ii) workplace safety;
      3. (iii) co-op performance standards; and
      4. (iv) professional conduct requirements for a cooperative education employee.

3. (3) A participating institution shall:

   1. (a) maintain documentation systems for:

      1. (i) placement agreements;
      2. (ii) performance reports;
      3. (iii) incident records; and
      4. (iv) program evaluations; and

   2. (b) implement procedures for:

      1. (i) issue resolution;
      2. (ii) performance intervention;
      3. (iii) placement modification; and
      4. (iv) program termination.

4. (4) A cooperative education employer shall:

   1. (a) maintain appropriate insurance coverage;
   2. (b) in accordance with Subsection (1), indemnify participating institutions against claims arising from cooperative education placements;

   3. (c) regarding a cooperative education employee, notify the relevant participating institution of:

      1. (i) performance concerns;
      2. (ii) policy violations;
      3. (iii) workplace incidents; and
      4. (iv) proposed terminations; and

   4. (d) regarding a cooperative education employee, document and report to the relevant participating institution:

      1. (i) workplace injuries;
      2. (ii) safety incidents;
      3. (iii) policy violations; and
      4. (iv) program departures.
