1. (1) A secondary student may attend a technical college described in Section 53H-3-1202 if the secondary student's career and technical education goals are better achieved by attending a technical college as determined by:

   1. (a) the secondary student; and
   2. (b) if the secondary student is a minor, the secondary student's parent.
2. (2) A secondary student served under this section by a technical college described in Section 53H-3-1202 shall be counted in the average daily membership of the sending school district or charter school.
