1. (1) Subsection (2) applies if the board determines that an operator has neglected, failed, or refused to:

   1. (a) plug and abandon a brine well;
   2. (b) close any surface impoundment;
   3. (c) repair a brine well leaking or causing waste; or
   4. (d) maintain and reclaim a site.

2. (2) A person who violates Subsection (1) shall forfeit from the person's surety or shall pay to this state a sum equal to the cost of:

   1. (a) plugging a brine well;
   2. (b) closure of the surface impoundment;
   3. (c) repair of the brine well leaking or causing waste; or
   4. (d) reclamation of the site.
