As used in this chapter:

1. (1) "Authorized agency" means:

   1. (a) the attorney general;
   2. (b) the state fire marshal;
   3. (c) any state law enforcement agency;
   4. (d) any criminal investigative department or agency of the United States;
   5. (e) a district attorney;
   6. (f) the prosecuting attorney of any municipality or county;
   7. (g) the department; or
   8. (h) the disciplinary section of an agency licensing a service provider.

2. (2) "Financial loss" includes:

   1. (a) out-of-pocket expenses;
   2. (b) reasonable attorney fees;
   3. (c) repair and replacement costs; or
   4. (d) claims payments.

3. (3) "Insurer" means any person or aggregation of persons:

   1. (a) doing insurance business, as defined in Section 31A-1-301; or

   2. (b) subject to the supervision of the commissioner under:

      1. (i) this title; or
      2. (ii) any equivalent insurance supervisory official of another state.
4. (4) "Knowingly" has the same meaning as in Subsection 76-2-103(2).
5. (5) "Person" means an individual, firm, company, corporation, association, limited liability company, partnership, organization, society, business trust, service provider, or any other legal entity.

6. (6)

   1. (a) "Runner" means a person who procures clients at the direction of, or in cooperation with a person who intends to:

      1. (i) perform or obtain a service or benefit under a contract of insurance; or
      2. (ii) assert a claim against an insured.

   2. (b) "Runner" includes:

      1. (i) a capper; or
      2. (ii) a steerer.

7. (7) "Service provider" means:

   1. (a) an individual licensed to practice law;

   2. (b) an individual licensed or certified by the state under:

      1. (i) this title;
      2. (ii) Title 41, Chapter 3, Motor Vehicle Business Regulation Act;
      3. (iii) Title 58, Occupations and Professions; or
      4. (iv) Title 61, Securities Division - Real Estate Division;
   3. (c) an individual licensed in another jurisdiction in a manner similar to a license described in Subsection (7)(a) or (b);
   4. (d) an individual practicing any nonmedical treatment rendered in accordance with a recognized religious method of healing; or
   5. (e) a hospital, health care facility, or person whose services are compensated directly or indirectly by insurance.

8. (8) "Statement" includes any:

   1. (a)

      1. (i) notice;
      2. (ii) statement;
      3. (iii) proof of loss;
      4. (iv) bill of lading;
      5. (v) receipt for payment;
      6. (vi) invoice;
      7. (vii) account;
      8. (viii) estimate of property damage;
      9. (ix) bill for services;
      10. (x) diagnosis;
      11. (xi) prescription;
      12. (xii) hospital or doctor record;
      13. (xiii) x-ray;
      14. (xiv) test result; or
      15. (xv) other evidence of loss, injury, or expense; or
   2. (b) item listed in Subsection (8)(a) that is a computer-generated document.
