1. (1) Each committee created under this part or formed by the commission in accordance with this section serves under the direction of the commission.

2. (2) In addition to the committees created under this part or formed by the commission, the following are committees of the commission and shall serve under the direction of the commission to assist the commission in performing the commission's duties:

   1. (a) the Behavioral Health Crisis Response Committee created in Section 63C-18-202;
   2. (b) the Utah Behavioral Health Policy Review Committee created in Section 26B-5-801; and
   3. (c) the Statewide Suicide Prevention Committee created under Section 26B-5-611.

3. (3)

   1. (a) In addition to the committees described in Subsection (2) or created under this part, the commission may form committees to support the commission in fulfilling the commission's duties.

   2. (b) When forming a committee, the commission shall, except as provided in Subsection (4):

      1. (i) appoint members to the committee who represent a range of views and expertise; and
      2. (ii) adopt procedures and directives for the committee.

   3. (c) Unless otherwise provided for in statute, a member of a committee may not receive compensation or benefits for the member's service on the committee, but may receive per diem and travel expenses in accordance with:

      1. (i) Section 63A-3-106;
      2. (ii) Section 63A-3-107; and
      3. (iii) rules made by the Division of Finance under Sections 63A-3-106 and 63A-3-107.
   4. (d) Compensation and expenses of a committee member who is a legislator are governed by Section 36-2-2 and Legislative Joint Rules, Title 5, Legislative Compensation and Expenses.
4. (4) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the department may make rules, in consultation with the commission, to establish the membership, procedures, and directives of a committee the commission forms.
