Utah Code Ann. § 26B-2-124.3

Whistleblower protections.

Effective Jul 1, 2025Enacted by Chapter 63, 2025 General Session
  1. (1) A congregate care program may not take any adverse action against a child or any other individual for:

    1. (a) communicating with the ombudsman;
    2. (b) cooperating with the ombudsman; or
    3. (c) facilitating the ombudsman in performing the ombudsman's duties under Section 26B-2-124.2.
  2. (2) An adverse action under Subsection (1) includes:

    1. (a) a termination;
    2. (b) a demotion;
    3. (c) a suspension;
    4. (d) a reduction in hours;
    5. (e) harassment;
    6. (f) intimidation;
    7. (g) creating a hostile work environment;
    8. (h) threatening to report an employee to licensing agencies or law enforcement without cause;
    9. (i) a reduction in pay, benefits, or access to opportunities; or
    10. (j) any other action that would deter a reasonable employee from performing any action described in Subsection (1).
