1. (1)

   1. (a) This part does not apply to an election of a board member of a special district.
   2. (b) Notwithstanding Subsection (1)(a), a special district may, in the special district's discretion, provide early voting in accordance with this part for election of a board member.

2. (2) Notwithstanding the requirements of Section 20A-3a-601, a municipality of the fifth class or a town as described in Section 10-2-301 may provide early voting as provided under this part for:

   1. (a) a municipal primary election; or
   2. (b) a municipal general election.
3. (3) A municipality is not required to conduct early voting for the election.
