The Right to a Hearing and How to Request a Hearing

  1. (1) A an applicant or client has the right to a review of an adverse decision or action by requesting a hearing. The request must be in writing and filed within 30 days of the decision being appealed, or in the event a mediation was terminated, the date of the notice of the termination. If the applicant or client requested a prior review or mediation, the request must be filed within 30 days of the decision by the field service director or the mediator.
  2. (2) Only a clear expression by the applicant or client seeking the opportunity to present their case is required.
  3. (3) The request for a hearing can be made at an USOR office or with the Adjudication Division.
