1. (1) the Department has not authorized in writing;
2. (2) the Consultant performs before the Department has an effective, fully executed contract with the Consultant; or
3. (3) the Consultant performs before the Department authorizes the Consultant to begin work by issuing a notice to proceed or similar writing.
