1. (1) Authority. This rule is made pursuant to Sections 32B-1-102 and 32B-8d-102.

2. (2) Definitions.

   1. (a) "Lounge or bar area" means:

      1. (i) the dispensing structure as defined in Section 32B-1-102;
      2. (ii) any area in the immediate vicinity of the dispensing structure where the sale, service, display, and advertising of alcoholic beverages is emphasized; or
      3. (iii) any area that is in the nature of or has the ambience or atmosphere of a bar, parlor, lounge, cabaret, or night club.

   2. (b) "Resort spa" means a facility within the boundary of a resort building that:

      1. (i) provides professionally administered personal care treatments such as massages, facials, hair care, and nail care;
      2. (ii) employs treatment providers properly licensed under Title 58, Occupations and Professions; and
      3. (iii) holds a license to conduct business as a spa or similar operation under local licensing laws.
