1. (1) This rule is made pursuant to Section 32B-2-202, which requires that criteria and procedures be established for determining the location of a state store.

2. (2) Before the Commission establishes a new state store, the Operations and Procurement Subcommittee will:

   1. (a) determine the feasibility of a new site;
   2. (b) weigh options;
   3. (c) consider the investigation and recommendation of the Department as outlined in Section 32B-2-502; and
   4. (d) make its recommendation to the Commission.
