1. (1) An applicant has the right to appeal a scholarship denial. Upon written request by the student, the scholarship staff shall provide an opportunity for the student to appeal a scholarship denial to a committee of at least three impartial persons.

   1. (a) Each appeal request must be submitted by the student to OCHE in writing within 30 calendar days of the scholarship denial unless the student demonstrates excusable neglect.

      1. (i) The appeal committee may not have jurisdiction to consider the merits of an appeal that is filed beyond the 30 day deadline unless the committee determines that the applicant established excusable neglect.
   2. (b) An appeal filed before the applicant receives official notification from scholarship staff of its decision will not be considered.
   3. (c) Any appeal submitted after 120 calendar days of the scholarship denial will not be considered and the initial scholarship denial decision is final.
   4. (d) The appeal committee shall review the appeal to determine if the award decision was made in error and the student is eligible for an award under this rule. The appeal committee shall review whether the applicant demonstrated substantial compliance with the scholarship application requirements but failed to meet one or more requirements for good cause.
   5. (e) The appeal committee will issue the student a written decision. The decision represents the final agency action. An applicant who disagrees with the decision may seek judicial review in accordance with Section 63G-4-402.
