1. (1) The division shall maintain and post a list of certified systems on the division website.

2. (2) To be included on the approved list of certified systems under Subsection (1), each manufacturer shall:

   1. (a) have a system that meets the certification standards in Section R708-31-4;
   2. (b) provide the division with a representative photograph of each certified system;

   3. (c) submit and comply with a quality assurance plan that includes procedures for:

      1. (i) checking the calibration;
      2. (ii) downloading the data;
      3. (iii) maintenance;
      4. (iv) checking for tampering; and
      5. (v) any other information regarding quality assurance unique to the system;

   4. (d) submit a detailed description of the system including:

      1. (i) a signed test certificate with complete test results as identified in Section R708-31-4;

      2. (ii) system serial numbers from the:

         1. (A) relay; and
         2. (B) handset;

   5. (e)(i) provide a certificate of insurance, issued by an insurance company authorized to transact business in Utah;

      1. (ii) provide an adequate product liability policy with a current effective date;
      2. (iii) specify the name and model number of the systems covered by the policy;
      3. (iv) maintain policy coverage of at least $1,000,000 per occurrence and 3,000,000 in whole;
      4. (v) list the manufacturer as the insured and the Department of Public Safety, Driver License Division as an additional insured;
      5. (vi) cover product liability coverage for defects in manufacture, materials, design, calibration, installation, and operation of the system; and
      6. (vii) ensure the insurance company will notify the division immediately upon cancellation and at least 30 days before terminating product liability policy; and
   6. (f) pay any applicable fees.

3. (3) Certification listed under this section shall expire:

   1. (a) five years after the date of issuance; or
   2. (b) upon changes or updates to the system including any hardware, or standards listed in Section R708-31-4.

4. (4) A manufacturer requesting a recertification or a renewal of a certification of a system shall submit:

   1. (a) a new application and fee; and
   2. (b) certification for each system showing compliance with the standards referenced in Section R708-31-4.
5. (5) The division may deny an application to renew a system certification or cancel an existing certification if there is pending action against the manufacturer, manufacturer representative, or provider for any violation of this rule, Rule R708-48, or Sections 53-3-1001 through 53-3-1008.
6. (6) A manufacturer who fails to maintain the standards in this rule will result in loss of certification of their system and removal from the approved list of certified systems.
7. (7) The division will approve or deny the certification and notify the applicant within 30 days of the determination.
