1. (1) Terms in this rule are defined in Section 53-3-102.

2. (2) In addition:

   1. (a) "act of moral turpitude" means conduct that:

      1. (i) is done knowingly contrary to justice, honesty or good morals;
      2. (ii) has an element of falsification or fraud; or
      3. (iii) contains an element of harm or injury directed to another person or another property;
   2. (b) "cancellation" means the certification is void;
   3. (c) "certification" means the process that public education teachers of driver education are certified by the Driver License Division to administer knowledge and driving skills tests;
   4. (d) "DEMS" means the Driver Education Management System, the division's official record keeping program;
   5. (e) "division" means the Driver License Division of the Utah Department of Public Safety;
   6. (f) "suspension" means that a teacher's certification is currently void but may be reinstated when the teacher follows a division-approved plan and complies with reinstatement procedures;
   7. (g) "teacher" means a teacher of driver education classes in the public schools of the state;

   8. (h) "test" means a division approved knowledge test or driving skills test as approved by the division; and

      1. (i) "USOE" means the State Office of Education.
