1. (1) Terms used in this rule are defined in Sections 53-3-102 and 53-3-502.

2. (2) In addition:

   1. (a) "act of moral turpitude" means conduct that:

      1. (i) is done knowingly contrary to justice, honesty or good morals;
      2. (ii) has an element of falsification or fraud; or
      3. (iii) contains an element of harm or injury directed to another person or another property.
   2. (b) "branch" means an office or location of business other than the schools' principal place of business;

   3. (c) "commercial driver training school" means a school that is licensed to conduct classroom, behind-the-wheel, and observation training, and may also be authorized to conduct:

      1. (i) home-study or online courses; or
      2. (ii) driving skills testing under R708-37.
   4. (d) "DEMS" means Driver Education Management System, the division's official record keeping program;
   5. (e) "license" means a commercial driver training school license, a testing only school license, a commercial driver training school instructor license or a commercial driver training school operator license issued in accordance with this rule;
   6. (f) "school" means a commercial driver training school or a testing only school;
   7. (g) "tester" means a school instructor who is certified to administer driving skills tests under Rule R708-37; and

   8. (h) "testing only school" means a school that is licensed to conduct:

      1. (i) driving skills testing under Rule R708-37; or
      2. (ii) behind-the-wheel or observation training.
