1. (1) for the first violation, a penalty of at most $300;
2. (2) for the second violation, a penalty of at most $750;
3. (3) for the third violation, a penalty of at most $1,500; and
4. (4) for the fourth or subsequent violation, a penalty of, at most, $5,000.

If a permittee is selling raw milk products without a permit issued by the department, the department may impose the following administrative penalties, pursuant to Subsections 4-2-304(1)(a) and 4-3-401(2):
