1. (1) The department may issue a variance on law or textile label and tag requirements.

2. (2)(a) A permittee may request a variance from the department in writing.

   1. (b) The variance shall contain the following information:

      1. (i) the product associated with the variance request;
      2. (ii) where the variance will be used;
      3. (iii) an explanation of the need for a variance;
      4. (iv) a description of the application of the variance in practice; and
      5. (v) an example of the substitute law or textile label, or tag that will be used instead of the required label or tag.
3. (3) The department shall approve a variance in writing.
4. (4) A variance shall be subject to a period of review.
