1. (1) The Division will:

   1. (a) review variance applications submitted pursuant to this rule;
   2. (b) determine facts relative to variance requests;
   3. (c) apply the provisions of this rule to relevant facts; and
   4. (d) grant or deny variance requests in accordance with this rule.
2. (2) Any variance request granted or denied shall be reviewed and approved by the Division director/designee before notice of decision is provided to the variance request applicant.
