1. (1) the rehabilitator has the facilities to hold the taxa of protected wildlife temporarily until the taxa are transported to a licensed rehabilitator for that taxa; and
2. (2) the temporary holding of the taxa must not exceed 72 hours.

The division may issue a temporary holding permit to a licensed rehabilitator to hold taxa of protected wildlife not specifically listed on the rehabilitator's certificate of registration provided:
