Funding Eligibility Criteria

  1. (1) To be eligible to receive funding from water infrastructure fund money, an applicant shall:

    1. (a) Engage in long-term planning consistent with Section 73-10g-602; and
    2. (b) Comply with Section 73-10g-605.
  2. (2) Eligible project categories are:

    1. (a) Drinking water;
    2. (b) Wastewater;
    3. (c) Stormwater and flood control;
    4. (d) Water reuse;
    5. (e) Watershed protection;
    6. (f) Secondary water;
    7. (g) Dam and reservoir;
    8. (h) Off-farm agriculture;

      1. (i) Water supply development; and
    9. (j) Hydropower.
  3. (3) The Division of Drinking Water is assigned the following category of eligible projects: drinking water.
  4. (4) The Division of Water Quality is assigned the following categories of eligible projects:

    1. (a) Wastewater;
    2. (b) Stormwater and flood control;
    3. (c) Water reuse; and
    4. (d) Watershed protection.
  5. (5) The Division of Water Resources is assigned the following categories of eligible projects:

    1. (a) Secondary water;
    2. (b) Dam and reservoir;
    3. (c) Off-farm agriculture;
    4. (d) Water supply development; and
    5. (e) Hydropower.
  6. (6) A project that falls within a category listed in Subsection (2) is not subject to the written prioritization process if it:

    1. (a) is an emergency water infrastructure project; or
    2. (b) is a small water infrastructure project.
