1. (1) Except as provided in Section 73-18-16, the operator of a vessel engaged in a towed watersport shall ensure an observer displays a flag in a visible manner such that other boaters in the area may determine a person:

   1. (a) being towed is in the water; or
   2. (b) is either preparing to be towed or is finishing being towed.

2. (2) The flag required by Subsection (1) shall be:

   1. (a) colored international orange;
   2. (b) at least 12 inches square; and
   3. (c) mounted on a handle.
