1. (1) A person may not, while a person is occupying or holding onto the swim platform, swim deck, swim step, or swim ladder of a motorboat, or while a person is being towed in a non-standing position within 20 feet of a motorboat:

   1. (a) operate the motorboat; or
   2. (b) allow the engine of the motorboat to run idle.

2. (2) The restrictions set out in Subsection (1) do not apply when a person is occupying the swim platform, swim deck, swim step, or swim ladder while:

   1. (a) assisting with the docking or departure of the motorboat;
   2. (b) exiting or entering the motorboat to or from the dock; or
   3. (c) a motorboat is engaged in a law enforcement activity.
