1. (1) The operator of a vessel towing a person on water skis, or another towed device shall maintain a safe course with proper lookout.

2. (2) Except as provided in Section 73-18-16, an observer who is not the operator shall:

   1. (a) observe the person being towed; and
   2. (b) report the progress of the person being towed to the vessel's operator.
