1. (1) The commissioner may terminate the order when there is no longer an industry need for the order.

2. (2) Upon the termination of the Order, the members of the board shall:

   1. (a) continue in their capacity until discharged by the commissioner upon dissolution of the board;
   2. (b) dispose of any remaining funds in a manner as the commissioner may determine to be appropriate; and
   3. (c) to the extent practicable, proportionally return funds to the producers who may have paid in excess.

3. (3) Producers may request a referendum vote once a year through a petition of 25% of the registered producers.

   R65-5-8. Rights of the Commissioner.

4. (1) Members of the board and any agents, employees, or representatives of the board shall be subject to removal or suspension by the commissioner at any time.
5. (2) Each rule, decision, determination, or other act of the board shall be subject to the commissioner's veto at any time.
